These Terms and Conditions govern access to and use of the ChocoAcademy online learning platform (hereinafter, “the Platform” or “LMS”), operated by SONIA DA CRUZ, with Tax ID (NIF) Y-6275592-X and registered address at Velázquez Moreno, 17 – 2º • 36202 VIGO, Pontevedra, Spain.

By accessing and using our Platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

1. DESCRIPTION OF THE SERVICE

ChocoAcademy is an online learning platform (Learning Management System - LMS) that provides access to educational courses, training materials, and multimedia content, including but not limited to:

• Supplementary learning resources
• Assessments and progress tracking
• Certificates of completion

2. REGISTRATION AND USER ACCOUNT

2.1 Registration: To access the Platform’s content, you must create an account by providing true, complete, and up-to-date information.

2.2 Personal and Non-Transferable Use: Your account is personal and non-transferable. Sharing your login credentials with third parties is strictly prohibited. Each user must have their own individual account.

2.3 Responsibility: You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

2.4 Notification: You must notify us immediately of any unauthorized use of your account or any other security breach.

3. ACCEPTABLE USE OF THE PLATFORM

By using ChocoAcademy, you agree to:

5. COURSE ACCESS

5.1 Duration of Access: Access to the courses will be available according to the specific terms of each course or program purchased.

5.2 Technical Requirements: You are responsible for having the equipment, software, and Internet connection needed to access the Platform.

5.3 Availability: We strive to keep the Platform available 24/7, but we do not guarantee uninterrupted access due to maintenance, updates, or circumstances beyond our control.

6. FAIR USE POLICY

To ensure an optimal experience for all users:

• Each account must be used by a single person
• Simultaneous access from multiple devices may be limited
• We reserve the right to monitor usage to detect abnormal activity

7. TERMINATION AND SUSPENSION

We reserve the right to suspend or cancel your account immediately and without prior notice if:

ChocoAcademy and SONIA DA CRUZ shall not be liable for:

• Any use you make of the information obtained in the courses

10. COMMUNICATIONS

By registering, you agree to receive communications related to your account and the courses in which you are enrolled. These communications are part of the service and you cannot opt out of receiving them while your account remains active.

11. CHANGES TO THE TERMS

We reserve the right to modify these Terms and Conditions at any time. Changes will take effect immediately upon publication on the Platform. Your continued use of the Platform after such changes will constitute your acceptance of the new terms.

12. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the courts of Vigo, Pontevedra, Spain.
